Sureties and Bail Bonds

How bail bonds and sureties work in Indian courts once bail is granted: documents, verification and obligations.

DLP's chamber: No. 548, A Block, High Court, Lucknow

What the law says

When a court grants bail, the accused signs a bond for a stated amount and, if the order requires, one or more sureties also sign bonds. A surety is usually a relative or acquaintance who undertakes to the court that the accused will appear. The court or its office verifies the surety's identity and means, often through property or income documents. Money is not ordinarily deposited; the bond is forfeited, wholly or partly, only if its conditions are broken. A surety may apply to be discharged. In India, sureties are individuals accepted by the court, not commercial agents.

Who can stand surety?

An adult whom the court accepts as reliable and of sufficient means, usually a relative or someone who knows the accused well. The court can reject a surety it considers unsuitable.

What documents does a surety usually need?

Identity and address proof, and proof of means such as property papers (for example a khatauni or registered deed) or income records. Requirements vary between courts, so check with the court office.

What happens if the accused does not appear?

The court can issue a warrant, cancel bail and start proceedings to forfeit the bond. The surety is given notice and a chance to explain before any penalty is recovered.
