DLP's chamber: No. 548, A Block, High Court, Lucknow
What the law says
Legal documents include agreements and contracts, sale, gift and lease deeds, partnership deeds, powers of attorney, legal notices and affidavits. Some documents must be registered under Section 17 of the Registration Act, 1908, for example sale deeds of immovable property and leases of more than one year. Stamp duty is payable under the Indian Stamp Act, 1899 as it applies in Uttar Pradesh; an unstamped or under-stamped document may not be admissible in evidence until the duty and penalty are paid. Clear drafting reduces later disputes.

Frequently Asked Questions
Which documents must be registered?
Among others, instruments transferring immovable property worth one hundred rupees or more, and leases of immovable property for more than a year, under Section 17 of the Registration Act.
What happens if a document is not properly stamped?
It may not be admitted in evidence until the deficit duty and penalty are paid, as the Stamp Act provides.
Is a notarised agreement the same as a registered one?
No. Notarisation attests the execution of a document; it does not replace registration where registration is compulsory.
