Motor Accident Claims

Compensation claims for death or injury in road accidents before the Motor Accidents Claims Tribunal.

DLP's chamber: No. 548, A Block, High Court, Lucknow

What the law says

Claims for death, injury or property damage caused by the use of a motor vehicle are filed before the Motor Accidents Claims Tribunal (MACT) under the Motor Vehicles Act, 1988. A claim can be made by the injured person, the legal representatives of a deceased person, or the owner of damaged property. The insurer of the vehicle is usually a party. Compensation is assessed on factors such as loss of income or dependency, medical expenses and pain and suffering. Separate compensation schemes apply to hit-and-run accidents. The Act, as amended in 2019, sets a time limit for filing, so claims should be made early.
