Insurance Claims
Disputes over rejected or delayed insurance claims before the Ombudsman, consumer commissions or courts.
DLP's chamber: No. 548, A Block, High Court, Lucknow
What the law says
Insurance is regulated by the Insurance Act, 1938 and the Insurance Regulatory and Development Authority of India (IRDAI). When a claim under a life, health, motor or property policy is rejected or delayed, the policyholder should first use the insurer's grievance process. The complaint can then go to the Insurance Ombudsman under the Insurance Ombudsman Rules, 2017, within the limits those rules set, or to a consumer commission. Disputes usually turn on the policy wording, disclosures made at the proposal stage, and exclusions.

Frequently Asked Questions
My claim was rejected. What first?
Ask for the rejection in writing with reasons, then file a complaint with the insurer's grievance officer, keeping the policy, claim forms and correspondence.
When can I approach the Insurance Ombudsman?
After complaining to the insurer, if it rejects the complaint or does not resolve it within the period the rules allow, within the time limit and value limit in the 2017 Rules.
Can a claim be rejected for non-disclosure?
An insurer may repudiate for material non-disclosure, but for life policies Section 45 of the Insurance Act limits this after three years from the policy date.
