Food Safety (FSSAI) Matters

Registration, licensing, notices and proceedings under the Food Safety and Standards Act, 2006.

DLP's chamber: No. 548, A Block, High Court, Lucknow

What the law says

Food businesses are regulated under the Food Safety and Standards Act, 2006 and the regulations made by the Food Safety and Standards Authority of India (FSSAI). Petty food businesses need registration, and other businesses need a State or Central licence depending on their size and activity. Food Safety Officers can inspect premises and draw samples; non-compliance can lead to improvement notices, suspension or cancellation of a licence, penalties decided by an Adjudicating Officer, and in some cases prosecution. Orders can be appealed as the Act provides.

Frequently Asked Questions

Do I need a registration or a licence?

Petty food businesses register; larger ones need a State licence or, for certain categories and scales, a Central licence. The thresholds are set by FSSAI regulations and can change, so check the current criteria.

What is an improvement notice?

A notice from the Designated Officer under Section 32 requiring specified measures within a stated time. Failure to comply can lead to suspension or cancellation of the licence.

A sample from my business failed. What happens?

You can ask for the sample to be re-analysed by an accredited laboratory within the time allowed. Depending on the result and the category of failure, adjudication or prosecution may follow.

Can I appeal a penalty?

Yes. Orders of the Adjudicating Officer can be appealed to the Food Safety Appellate Tribunal within the period the Act allows, and further remedies lie to the High Court.
